These Terms of Service (“Terms”) govern your access to and use of stayd.co, related Stayd websites, the Stayd careers portal, and the services offered by Stayd LLC, doing business as Stayd Collective (“Stayd,” “we,” “us,” or “our”). By using this website or our services, you agree to these Terms and to our Privacy Policy.

1. Who We Are

Stayd LLC is a U.S. company based in Orlando, Florida. We operate Stayd Collective, an operator-led group of independent vacation rental management brands, and StaydOS, the software and operating services that support those brands, including recruiting and hiring for Stayd and its member brands.

2. Our Services

Stayd provides, among other things:

• Information about Stayd Collective, our member brands, and our markets
• Software and operating services (including StaydOS) for partner property-management brands
• A careers portal where people can apply for jobs with Stayd and its member brands
• Guest-facing booking links and owner-facing property management information
• Transactional and informational communications, including SMS/MMS, that you have agreed to receive

Some services are provided by Stayd. Others are provided by an independent member brand (for example, a local vacation rental manager). When you book a stay or sign a management agreement, the contract for that stay or that management relationship is with the relevant brand unless we say otherwise in writing.

3. Eligibility

You must be at least 18 years old to use this website, submit a form, or opt in to Stayd text messages. By using the site you represent that you are 18 or older and have the legal capacity to agree to these Terms.

4. Using the Website

You agree to use stayd.co only for lawful purposes. You may not:

• Attempt to interfere with, scrape in an abusive way, or disrupt the website or our systems
• Submit false, misleading, or infringing information
• Use the site to send unsolicited commercial messages
• Circumvent security, access controls, or consent flows (including SMS opt-in)

We may change, suspend, or discontinue any part of the website at any time. Content on the site is for general information and is not an offer, guarantee of availability, or professional advice.

5. Bookings, Listings, and Property Management

Vacation rental listings, rates, availability, house rules, and guest stays are managed by the member brand that operates the property. Stayd is not the innkeeper for those stays unless a specific booking confirmation says otherwise.

Property management inquiries submitted through stayd.co may be shared with the relevant Stayd member brand so they can respond. Submitting an inquiry does not create a management agreement.

6. SMS Program Terms

This section is the terms and conditions for the Stayd text messaging program. It applies in addition to the rest of these Terms.

Program description

Stayd sends recruiting texts to job applicants who opt in, including interview scheduling, interview reminders, and application status updates, and customer care texts, including replies to questions you send us, appointment reminders, and service updates. We do not send promotional or marketing texts through this program, and we do not send messages on behalf of unaffiliated third parties.

How you opt in

You will only receive program messages after you provide a mobile number and give prior express consent to SMS/MMS from Stayd. Ways to opt in:

• Checking the optional SMS consent box next to the phone number field on the Stayd job application (the box is never pre-checked)
• Texting our recruiting line at (321) 450-7371 first, for example by texting START or asking about your application

Consent is not a condition of applying, of employment, or of any purchase. You may apply for jobs and use Stayd websites and services without agreeing to receive text messages.

Message frequency

Message frequency varies. You may receive up to 10 msgs/month. Actual frequency depends on where your application is in our process and the requests you make.

Rates

Message and data rates may apply. Stayd does not charge a fee to receive program messages, but your mobile carrier may charge standard messaging or data rates according to your wireless plan.

Help and opt-out

HELP: Reply HELP to any Stayd text for assistance, or hello@stayd.co.

STOP: Reply STOP to any Stayd text to opt out. You may also reply CANCEL, UNSUBSCRIBE, END, or QUIT. You will receive a one-time confirmation that you have been unsubscribed. After that, you will not receive further program messages unless you opt in again.

Supported carriers

The program is compatible with all major U.S. carriers, including AT&T, Verizon, T-Mobile, and U.S. Cellular. Carrier participation is not guaranteed and may change.

Carrier liability

Carriers are not liable for any delayed or undelivered messages. Wireless carriers and Stayd are not responsible for delayed or undelivered messages due to carrier issues, network problems, device settings, or incorrect mobile numbers.

Privacy of mobile information

How Stayd handles personal information, including mobile numbers and SMS consent, is described in our Privacy Policy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

7. Intellectual Property

The Stayd name, Stayd Collective name, StaydOS name, logos, and site content are owned by Stayd or our licensors. Member brand names and logos remain the property of those brands. You may not copy, scrape, or reuse our content except as allowed by law or with our written permission.

8. Disclaimers and Limitation of Liability

The website and our services are provided “as is” and “as available.” To the fullest extent permitted by law, Stayd disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

To the fullest extent permitted by law, Stayd and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the website or our services. Our total liability for any claim relating to the website will not exceed one hundred dollars (US $100).

You agree to indemnify Stayd against claims arising from your misuse of the site, your violation of these Terms, or your violation of applicable law.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that courts located in Florida will have exclusive jurisdiction over disputes arising from these Terms, except that we may seek injunctive relief in any jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of the website or participation in the SMS program after changes take effect constitutes acceptance of the updated Terms.
